FREC Rule Regarding Mailing Address Modified
The Florida Real Estate Commission (FREC) removed the word "residential" from Rule 61J2-10.038, allowing agents to designate their preferred official mailing address. Mailing and email address changes must be sent to the DBPR in writing within 10 days after the change.
TALLAHASSEE, Fla. – The Florida Real Estate Commission (FREC) modified Rule 61J2-10.038: Mailing Address: Place of Practice: Requirement for Notification to allow licensees to designate a mailing address to report to the Florida Department of Business and Professional Regulations (DBPR). Before this change, licensees were required to use their personal residential addresses.
The rule modification, effective July 18, 2024, removed the word “residential” from the rule, as follows:
61J2-10.038 Mailing Address: Place of Practice: Requirement for Notification.
(1) Pursuant to Section 455.275(1), F.S., the Commission defines “current mailing address” as the current residential address which is used by a licensee or permit holder to receive mail through the United States Postal Service. The Commission defines “place of practice” as the physical location of the Real Estate Brokerage office established and maintained pursuant to Section 475.22(1), F.S.
Licensees and permit holders are required to notify the DBPR in writing of the current mailing and email address and any change in the current mailing or email address within 10 days after the change.

(2) Each licensee and permit holder is required to notify the Department in writing of the current mailing and email address and any change in the current mailing or email address within 10 days after the change. A first time failure to comply with this requirement shall result in the issuance of a Citation; second or subsequent violations will result in disciplinary proceedings against the licensee.
